Getting OEM binded with a used motherboard, is it legal?

- I got win 10 home activated without asking for a key. I made a custom PC and bought a used motherboard(ASUS H81M) seperately(I didn't bought and modify a branded PC). - Also, does it depends upon good hardware getting better edition or it is a fixed edition by manufacturer? - As told its used, is it legal for me to use the oem key used by another person before?- Also I don't really know if the motherboard had an original oem key or it was bought online and binded with it. (I am just thinking. Nobody told me if it had an online illegally bought key)
