Having an issue activating Windows 7 Home Premium

Is there a way to "activate" my Windows 7 Home Premium 64bit legitely after installing upgrade copy as full version, but it was only an upgrade CD, by using former hard drive to verify the previous Windows version (XP) or do I have to buy a full retail copy?

I no longer possess my Windows XP cd that I had used on the original hard drive which I recently replaced due to failure.
