Microsoft recently updated the terms of their Open and Select EULAs to try to put a stop to bargain-basement software licensing.

 

Thing is, this raises the question of how Microsoft can legally add "Not For Resale" clauses to EULAs. The posts to the article's comment thread are nearly unanimous in putting it down as being unenforcable.... and the company in question has found a work-around anyway.

 

So with the launch event in March, can Microsoft really go after people for selling on their freebie copies of Visual Studio and Windows Server?

 

...because MS got eBay to close an auction a friend of mine made after he put up his free copy of VS2005 after attending that launch event.

 

//not that I'd be selling mine, I have legitimate uses for the complimentary licenses for VS, WS, and SQL Server.
